Law and Transgressión / La ley y la transgresión

This topic has nothing to do with Crime and Punish-ment. It is less existential and more sociological.

I have been living for so long in Venezuela that I have lost track of my original Anglo-Saxon respect for law. I remember once, when I still lived in the United States, having a heated discussion with someone about a matter I have long since forgotten, but my closing and concluding argument was, “But it’s in the Constitution!!” In other words, the law seemed to be beyond all question.

But that was many years ago, and times have changed almost everywhere. Characters in movies that feature the police and detectives often derive their motivations for justice from personal revenge rather than respect for the law. People bend the rules in order to achieve their goals. Red traffic lights signal the need to speed up in order to take advantage of the last microsecond before the other cars begin to move, rather than an order to stop one’s vehicle. Everyone does it.

Including the presidents and the members of congress of legislative assemblies. Law is no longer a set of agreed-upon, formal, almost sacred rules. In government it is mostly tailored to achieve certain restricted political ends. Bush openly declares himself above it. Chávez has made his own will into legal writ where the language is so vague that he and his followers can interpret the limits however they want to.

The Freudian tribal father is killed by his sons, thus giving rise to the need for consensual law. But the mother is the survivor that bends regulations so that her sons might outlast both the angry father, and the inconvenient rules society imposes on her children. It has been said that Venezuela is a country of mother’s sons rather than the father’s children, and that rules seldom motivate anyone. The law here represents a sort of goodness-of-fit, where an average line is drawn on a graph between all the absolutely forbidden points and the theoretically necessary ones. Only some traffic lights are obeyed. Taxes are paid if you might get caught for not doing so. One tells the traffic cop, ”There must be some way for us to fix this….”

I have an explanation about the origin of this state of things here: I believe it is a colonial inheritance. The colonial masters needed to have nurturing mothers to rear the next generation of slaves, free workers, small shop owners and other lower class inhabitants of the new territories. But they didn’t need strong masculine figures that would defend their homes and develop, obey, and oblige respect for a set of agreed-upon rules for living. These men, when they appeared, were destroyed. The mothers knew this, and in order to protect their sons, they brought them up to be irresponsible and rule-bending, rather like women in this regard. Negligent fathers and wily subjects of the crown are not likely to want to defend their families and land against imposing masters. Today these men’s inheritors come to regard themselves as “real machos”, but in reality they have been kept immature for historically irrelevant reasons.

Of course, my hypothesis doesn’t explain how these same men (and women) rose up against the Spanish in 1811 and liberated all of Andean Latin America from colonialism. It’s a small theoretical problem! Or how their descendants, men and women, put their unarmed bodies between their threatened constitutional government and an impending coup d’etat in 2002. But we are talking about respect for the law, not bravery in the face of tyranny.

It would be a true mistake to restrict this personality type to one nation. I believe that most of the world’s upper class has similar traits, but for different reasons. The upper class usually has no need to band together and make sacrifices in order to defend family and nation. These people as a rule have individual interests, although they may form transient agreements and cartels to enhance them. Thus they, too, remain essentially immature and irresponsible in terms of the greater good.

Another aspect of this rule-bending can be seen in a general disregard for the public wellbeing. The best describing metaphor is the behavior for waiting in line. The usual way things are done is to sidle up to someone who is in a better position in order to cut-in when nobody notices. Or in a queue of cars, to squeeze onto the shoulder of the road and later wedge in at some better point ahead of the other more complacent drivers.

It is curious that in Venezuela few people object when they are the victim of this kind of behavior. People often accept this abuse passively, and I think this happens because they know that an overly strict application of the rules will oblige them to obey at some later time when they too might take advantage of squeezing in ahead of the others. A fragile equilibrium of complicity is achieved.

The photo shows a traffic jam in which the main line of cars that were waiting for a jam-up to lessen was suddenly surrounded by vehicles both on the right and the left, taking advantage of everyone else. My car was caught in the middle and I had nothing to do but take pictures.

Este asunto no tiene nada que ver con el Crimen y Castigo. Es menos existencial y más sociológico.

He vivido tanto tiempo en Venezuela que he perdido mi respecto anglosajón por ley. Recuerdo una vez, cuando todavía vivía en los Estados Unidos, una discusión calentada con alguien sobre un tema que he olvidado, pero mi argumento de cierre era, "¡Pero está en la Constitución!!" Es decir, más allá de la ley no había nada más que añadir.

Pero esto fue hace muchos años, y los tiempos han cambiado casi por todas partes. Los personajes en las películas que representan al policía y a los detectives derivan sus motivaciones para la justicia sólo de venganza personal. La gente tuerce las reglas para alcanzar sus metas: los semáforos rojos señalan la necesidad de acelerar para aprovechar el microsegundo que queda antes de que los demás comiencen a moverse. Todo el mundo lo hace.

Incluyendo los presidentes y los miembros de los congresos y las asambleas legislativas. La ley ya es no un sistema acordado, formal, de las reglas casi sagradas. Los gobiernos formulan leyes para lograr beneficios para los gobernantes. Bush abiertamente se declara por encima de la ley y Chávez ha convertido su propia voluntad en legislación nacional.

Los hijos freudianos matan al padre tribal, así dándose lugar a la necesidad de la ley consensual. Pero la madre es el sobreviviente que dobla e interpreta los reglamentos de modo que sus hijos puedan perdurar más tiempo, tanto frente a la furia del padre como a las restricciones de la sociedad.

Se ha dicho que Venezuela es más bien un país de los hijos del lado materno que los niños del padre, y que las reglas raramente motivan a nadie. La obediencia a la ley aquí puede describirse como un cociente gráfico donde los puntos en una curva representan la diferencia entre los actos absolutamente prohibidos y aquellos que son teóricamente necesarios: solamente se obedecen determinados semáforos, y se pagan los impuestos si existe el peligro de que descubren la morosidad. Uno le pregunta al oficial de tránsito:, "¿Cómo podemos arreglar esto...?"

Tengo una hipótesis sobre el origen de este estado de cosas: creo que es una herencia colonial. Los amos coloniales necesitaban contar con madres cariñosas y sumisas para criar la generación siguiente de esclavos, trabajadores libres, tenderos y los demás miembros de las clases bajas de los territorios nuevos. Pero no necesitaban la figura masculina que defendería su hogar y que acordaría, obedecería, y obligaría respecto por un sistema de reglas convenidas. Los amos destruían a estos hombres cuando aparecían. Las madres sabían esto, y para proteger a sus hijos, los formaban para que fueron irresponsables y “vivos”, similares a mujeres en esto respeto. El razonamiento colonialista era que los padres negligentes y los subyugados a la corona no serían defensores de sus familias y de la madre-tierra. Hoy en día este tipo de hombre se considera un "macho verdadero", pero en realidad la sociedad los ha mantenido inmaduros por razones atávicas.

Claro, mi hipótesis no explica como estos mismos hombres (y mujeres) alzaron contra los españoles en 1811 y liberaron casi la totalidad de la América andina. ¡Es sólo un pequeño problema teórico!. O como sus descendientes impusieron sus cuerpos sin armamento entre su amenazado gobierno constitucional y un golpe de Estado en el 2002. Pero hablamos de respeto por la ley, no del coraje para oponerse a la tiranía. Parece que la estrategia de los colonialistas fracasó en este respecto.

Sería un error restringir este tipo de personalidad a una sola nación. Además creo que la mayoría de la clase alta del mundo tiene rasgos similares, pero por diferentes razones. La clase alta no tiene generalmente ninguna necesidad de unirse y hacer sacrificios para defender la familia y su nación. Esta gente comúnmente tiene intereses individuales, aunque ella puede formar acuerdos transitorios, tratados y cárteles de negocios. Por esta razón sus miembros son esencialmente inmaduros e irresponsables, sobre todo con respecto al bien común.

La mejor metáfora que describe este comportamiento es la espera para algo en una cola ordenada. Generalmente los “vivos” se ubican, como si nada, al lado de alguien que tiene una posición mejor en la línea de las personas que permanecen allí, hasta tener la oportunidad de meterse en frente. O en una cola de carros, se deslizan por el hombrillo de la derecha hasta encontrar un espacio más adelante. Es curioso que en Venezuela pocas personas se oponen a este trato cuando son las víctimas. A menudo la gente acepta este abuso pasivamente, y creo que esto sucede porque se sabe que en un futuro próximo puede hacer lo mismo. Se trata de un equilibrio frágil de complicidad.

La foto demuestra un embrollo de tráfico en el cual el canal principal de carros esperaba para poder volver a andar, pero fue rodeada repentinamente por vehículos a la derecha y al izquierdo, aprovechándose de cualquier espacio mínimo donde podrían introducirse. Mi auto fue apresado en el centro.

Es un poeta que va a llegar lejos. No puedo poner un comentario directamente sobre su página porque no estoy inscrita en myspace, pero si algún lector quiere jactarse en diez años que ha visto estas primeras obras del bardo, aquí está el URL.

Autonomy / Autonomía

University autonomy in Latin America is an important issue that transcends particular governmental administrations. It means that the police or the military cannot enter university grounds for repressive purposes, although they can do so to participate in events, take classes or for other strictly academic or sports activities. Autonomy also means that the universities and research institutions can vote for their own administrators and manage their own finances.

All this has certain disadvantages because they cannot benefit from repressive protection, but the benefits far outweigh this problem. The university has the responsibility that the churches had in the Middle Ages, that is the protection of knowledge and reason from transient and sometimes brutal regimes. It is a defensive institution that has sometimes failed, as in the dictatorships in Argentina, Chile, Uruguay, and Brazil, and the repression that occurred in Mexico and Venezuela the 70s and 80’s.

This freedom can lead to trouble. I have mentioned the lack of police protection, but in fact, the university guards probably do at least as good a job as the municipal authorities do. There is rampant financial disorder, but, of course, one can also find this problem in the government. One must conclude that the benefits far, far exceed the difficulties.

In Venezuela these days university autonomy is being questioned. Academic authorities tend to oppose President Chávez and his policies, and he feels that this institution is a thorn in the realization of his new socialism. For my part I would like to see the place as a safe haven for political debate.

This is the reason I no longer participate in demonstrations. I need to think in paragraphs and not in short, shouted, rhyming phrases. This is why I went yesterday to the assembly in the Aula Magna, the great ceremonial hall of the Central University, whose mission it is to be The House that Prevails over Shadow.

Unfortunately most of the debate was incredibly shallow yesterday and the prepared speeches could have been given at a pep rally. There were notable exceptions, the most remarkable being a representative of a neighborhood organization called ”Radar de los Barrios”. He mentioned the general need for citizen autonomy in all civic organizations even the new communal councils, associations that run parallel to the city councils and that are largely managed by pro-government activists. I do not want to discuss these councils just now, but in the future I will. Another exception was not a prepared speech, but rather an intervention made by the professor in the above picture. When a group of people tried to drown the debate with their shouts, this gentleman invited them to participate in an organized way from the podium.

Yesterday’s shallowness in its response to Chavez’s propositions was unfortunate. I have been participating in a “Diploma” graduate program in which government supporters and members of the opposition have been debating for a semester. We have dealt with topics like democracy, education, activism, and participation in historical and philosophical terms. This is what the university has to offer: reasonable discourse. We have not dealt with the problem of autonomy yet, but we should. We should be asking things like:

1. What does the institution of autonomy mean for Venezuela?
2. How is academic debate about political matters different from political debate in the public arena?
3. How can political matters be discussed reasonably? How can they be discussed ethically?
4. How are political “facts” developed and what do they represent? What do they describe? What purposes do these serve?
5. How can academic debate recognize and deal with political emotion?

La autonomía universitaria en América latina es un asunto importante que supera los gobiernos individuales. Significa que la policía o los militares no pueden entrar en los terrenos universitarios para reprimir, aunque lo pueden hacer para participar en actividades propias del lugar. Autonomía también implica que las universidades y las instituciones de investigación pueden votar por sus propios administradores, decidir los requisitos para obtener títulos, organizar actividades de investigación y manejar sus propias finanzas.

Esto tiene ciertas desventajas porque no pueden beneficiarse de la protección de las fuerzas de orden, y hay, como en todas las instituciones, corrupción financiera, pero las ventajas son enormes. La universidad tiene la misma responsabilidad que las iglesias medievales, es decir la protección del conocimiento y de la razón frente a regímenes transitorios y veces brutales.

La autonomía es una institución defensiva que ha fallado a veces, como en las dictaduras de Argentina, Chile, Uruguay y Brasil en las décadas de los 70 y 80, y la represión en México y Venezuela en los 60 y 70.

Actualmente en las universidades de Venezuela la autonomía está en peligro. Las autoridades académicas tienden a oponerse a las políticas del actual presidente del país, y Chávez siente que esta institución es un estorbo para la realización de su nuevo socialismo.

Por mi parte quisiera ver el lugar como asilo seguro para la discusión política. Por esta razón ya no participo en demostraciones. Necesito pensar en párrafos y no en los lemas rítmicos que se gritan a los transeúntes mientras uno camina por las calles.

Por esta razón fui ayer a la asamblea en la Aula Magna de la Universidad Central, cuya misión es ser la Casa que Vence la Sombra.

La mayor parte de los conferencias ayer fueron increíblemente superficiales. Había excepciones notables, la más notable era un discurso dado por un representante de una organización vecinal llamado "Radar de los Barrios". Mencionó la necesidad general de autonomía ciudadana en organizaciones del Estado, incluyendo los nuevos consejos comunales, asociaciones que funcionan paralelamente a las alcaldías y que son manejadas en gran parte por los activistas pro -gobierno. No deseo hablar de estos consejos ahora, pero en el futuro lo haré.

También hubo una reflexión interesante sobre la historia de la autonomía en Venezuela. En otra contribución la presidenta de la Asociación de Investigadores del Instituto Venezolano de Investigaciones Científicas denunció la intromisión del gobierno en su institución.

Otra excepción a la mediocridad fue la intervención del Dr. Ríos (en la foto). Cuando un pequeño grupo intentó sabotear el debate con sus gritos, este caballero invitó a un representante del grupo a participar de manera organizada desde el podio. Fue un gesto de inclusión digno de la universidad.

La superficialidad de mucho del discurso universitario ayer era desafortunada. He estado participando en un programa de postgrado, un “diploma" en el cual partidarios del gobierno y miembros de la oposición han estado discutiendo por un semestre. Hemos podido hablar de temas como la democracia, la educación, el activismo y la participación en términos históricos, filosóficos y de sus manifestaciones en la actualidad, y lo hemos hecho generalmente con cordialidad y como una experiencia de crecimiento mutuo. Esta es la tarea de las instituciones de educación superior. No nos hemos ocupado del problema de la autonomía de la universidad todavía, pero deberíamos hacerlo. Deberíamos considerar temas como:

1. ¿Qué significa la institución de la autonomía para Venezuela?
2. ¿Qué diferencias hay entre la discusión académica sobre asuntos políticos y la discusión política en la arena pública?
3. ¿Cómo se puede hablar racionalmente de asuntos políticos? ¿Cómo podemos hablar de ellos de manera ética?
4. ¿Cómo se desarrollan los "hechos" o “datos” y qué representan? ¿Qué describen? ¿Qué propósitos tienen?
5. ¿Cómo puede la academia ocuparse de la emoción política?

Little lizzard / Lagarto

I have an evening visitor who quickly climbs the wall behind my computer and normally hides behind a wood-strip window shade. He (she) is definitely a friend, even though he is a little lizard. It all happens very quickly. Tonight, however, he stayed on the shade long enough to be photographed.

There are a number of visitors here. Birds visit a feeder outside the dining room and occasionally come in through a window. Unfortunately sometimes mice get into the cupboard. Since I no longer have any cats, they have to be convinced by my dogs to go elsewhere, and canine hunters are not as good as feline ones for this purpose. Now and then a spider comes in and has to be trapped in a wide-rimed cup to be returned to nature. A sporadic garden snake gets in under the door and has to be removed at the end of a broom.

My family and city friends are scandalized by my closeness to non-human creatures and think I need more homo sapien company. Not that I don’t have contacts with this last species. But I can develop a profound interchange with my dogs, and I know that they communicate with the direction of their glances, their facial expressions, their ear and tail movements and their general posture. Their emotional capacity can only be described as enriching. All animals transmit their feelings. Once I saw a “conversation” where a bird made fun of a cat to the point of making him furious.

Really, there’s not much difference between us and the other creatures on this Earth.

Tengo un visitante que sube la pared detrás de mi computadora y normalmente se esconde detrás de una persiana hecha de tiras de madera. Definitivamente es un amigo, a pesar de su condición de lagarto. Normalmente nuestros encuentros ocurren muy rápidamente, esta noche, sin embargo, quedó sobre la cortina tiempo suficiente para sacarle un retrato.

Hay varios visitantes. Los pájaros visitan un alimentador fuera del comedor y de vez en cuando entran por una ventana abierta. Desafortunadamente ocurre en ocasión que algunos ratoncitos dan una vuelta por el escaparate de la cocina, los perros tienen la responsabilidad de desanimarlos aunque no son tan buenos cazadores como los gatos, y por ahora no tengo mininos. De vez en cuando una araña entra y hay que sacarla colocándole encima una taza ancha para luego devolverle afuera a la naturaleza. Cuando una culebrita de jardín se desliza por debajo de la puerta, es necesario sacarle con una escoba.

Mi familia y mis amigas de la ciudad se horrorizan con mi cercanía con las seres no-humanas y piensan que necesito más compañía entre los homo sapiens. No es que no tengo gente próxima de esta especie, pero sí, me siento bien acompañada de otros organismos. Puedo entrar en profundo intercambio con mis perros, y sé que se comunican por la dirección de sus miradas, las expresiones de sus caras, el movimiento de sus colas y orejas y su postura en general.

Todos los animales transmiten sus sentimientos. Su capacidad emocional nos enriquece a nosotras, las personas. Una vez observé una “conversación” donde un pájaro de burló a un gato al punto de hacerle rabiar.

En el fondo, no hay mucha diferencia entre las criaturas de este mundo.
